DIAN Global Education Ltd (‘DGE’), through its website, www.dgelearn.com (the ‘Website’), enables the internet visitor/user to access its educational and training material and to make use of the pages and services on offer. Please, read carefully the following Terms of Use.

The use of the Website implies the full and unreserved acceptance of the Terms of Use, which are applied to the entire content of the site. In case that the visitor/user of the Website does not agree with any part of these Terms, the visitor/user must exit the Website and make no further use of it.

By visiting or using the Website, visitors/users acknowledge that they have read, understood and unconditionally accepted the Terms of Use and agree to be bound hereby.

DGE may unilaterally modify the present terms at anytime, without notice. The use of the Website after the announcement of the modification shall be deemed to constitute an acceptance of such modification.

Copyright / Intellectual & Industrial Property Rights

The content of the Website, including, indicatively but without limitation, trademarks, distinctive titles, texts, news, logos, services on offer, is owned by DGE and is governed by the relevant provisions of Cyprus and International Law, mainly concerning Intellectual and Industrial Property, with the exception of protected third party rights.

Consequently, no modification, publication, transmission, transfer, reproduction, distribution, presentation or any use of the content -in whole or in part- of the Website is permitted in any way or by any means for commercial or other purposes, without the prior written consent of DGE.

Exceptionally, limited or isolated copying, printing or storage of parts of the aforesaid content is permitted for the visitor’s personal use, provided that it is accompanied by a clear and distinct acknowledgement of the source of origin and that they will not be used for commercial or other purposes.

User Conduct / Conditions of Use / Impermissible Use of the Website

The Website shall be used for lawful purposes only and in a manner that does not restrict or inhibit its use by any third party. The visitors/users of the Website ought to comply with the rules and provisions of the Cyprus, European and International Law and the legislation governing telecommunications, act responsibly towards other users and the service providers, and refrain from any illegal and abusive/inappropriate behavior which may have negative consequences for other visitors/users and cause damage to or disruption of the Website, the services offered through it, and by extension to DGE.

In the event of the DGE finding itself involved in any litigation or required to pay any kind of compensation as a result of a breach by the visitors/users of their obligations, the visitor/user shall be liable to compensate DGE accordingly.

All users therefore agree that all access and use of the Website and any externally-linked pages are at the user’s own risk. Consequently, DGE, under no circumstances, even in the event of negligence, shall be liable for any errors, omissions or deficiencies concerning the provision of information, including, without limitation, the content and any errors contained therein provided by third parties, or for any delay, interruption or inability in the transmission of information or any damage caused to the visitor/user due to the use of such information.

Further, to the fullest extent permissible by law, we disclaim any express or implied warranties, including, without limitation, non-infringement, title, merchantability or fitness for a particular purpose. We do not warrant that the functions contained in the Website or any materials or content contained therein will be completely secure, uninterrupted or error free, that defects will be corrected, or that the Website or the server that makes it available is free of viruses or other harmful components.

Moodle Platform

Our e-learning courses are set up using the Moodle™ open source software package. Moodle is distributed by its creators and used by DGE without any warranty. For more information, visit http://moodle.org.

Website Security

Access to the Website is provided on the initiative of the visitor/user and not on the initiative of DGE.

The visitor/user of the Website is solely responsible for obtaining and maintaining the necessary equipment (e.g. personal computer), software, telecommunication equipment and any other service needed for access to the site. Users are also responsible for protecting their system against viruses and other malicious software.

DGE has made every possible effort to ensure that all security measures have been taken to protect the Website against viruses and other malicious software and uses security systems to control access to its web pages in order to prevent attacks and any other unauthorized actions, but it does not warrant that the content of the Website will be free from viruses, faults and other harmful components and consequently in no event shall be liable for any damage caused to the abovementioned user’s equipment, software and files, as well as for any damage incurred by the user, due to any of the above causes.

Privacy Policy / Personal Data

The management and protection of personal data of the visitor/user of the Website are governed by the present Terms of Use, the provisions of Cyprus Law, as currently in force, and the Decisions, Directives and Regulations of the Commissioner for Personal Data Protection.

Without prejudice to the provisions of the following paragraph, the personal data will not be communicated to any third party unless applicable law requires the disclosure of such data to the competent Authorities and to them only.

The aforesaid data may be stored and processed by DGE for communication and statistical purposes as well as to improve the services on offer. By using the Website, the visitors/users give their consent for the use of such data by DGE.

The Website may contain special connections (links, hyperlinks, banners) to other websites operated by third parties. Should the visitor/user of the Website choose to follow the links to third party websites, DGE in no event shall be responsible for the terms concerning the management and protection of personal data, applicable to linked sites.

Payment Methods & Refund Policy

There are two different ways to pay for your subscription:

1) Payment by credit card (VISA, MASTERCARD, AMERICAN EXPRESS).

The collection of your card details, their verification and the charging are performed in a secure environment (SSL) of PayPal. The Website does NOT handle or store any credit card information.

2) Using your PayPal account.

Subscribers who are informed about problems with their order due to a course cancellation, or are unable to access the course after a reasonable interval following subscription, as a result of a technical fault on the part of DGE, are entitled to a full refund. No refunds are provided for any other reason.

A purchase with description “www.dgelearn.com” will appear in your bank statement.

Governing Jurisdiction

These Terms & Conditions and the use of the Website are governed by Cyprus Law. The competent Courts of the Republic of Cyprus are competent to interpret the present terms and to settle any dispute arising from the present contract of use. If any of the present terms is held to be contrary to Law and consequently void or voidable, the invalidity or unenforceability of such term shall not affect the validity or enforceability of the remaining terms.

The Website is provided from Cyprus. The laws of other countries may differ regarding the access and use of the Website. DGE makes no representations regarding the legality of the Website in any other country and it is your responsibility to ensure that your use complies with all applicable laws outside of Cyprus.
